I'm having a discussion with an Ohio A&M student that doesn't believe that there was a lawsuit between the two schools regarding the word Ohio. Can someone provide me with links to the appropriate documentation?

Here is my recollection of relevant events from that period when I was offering some counsel to Ohio's then director of legal affairs who sent me copies of Ohio's trademark registration documents.  (I was then responsible for promoting and protecing for my company's trademarks and brands.)

Ohio regisered OHIO as a trademark for use on licensed apparel and merchandise.  (Other universities in other states had done likewise.  Examples, as I recall, then included Indiana, Michigan and Florida.) 

When an entity registers a trademark, another entity has a stipulated period during which it can file a protest. 

If the Trademark office finds the protest has merit, the protestor can bring a suit that will be heard not in a Court of Law but in an Administrative Court.

There is no obligation for an entity that has registered a trademark to notify any other entity that it thinks might want to protest.

That having been said, just before the protest period would have ended regarding Ohio's registration of OHIO, someone from Ohio did in fact unwisely disclose to OSU the registration in question.

OSU rushed to file a protest before the deadline for doing so.

That's when the media began having fun with the issue.  The Wall Street Journal, for example, gave it tongue-in-cheek treatment on the front page of one of its sections.  Matt Lauer on Today did a balanced treatment of the dispute - and ended it with hoisting an OHIO logo'd coffee mug.

Then Bob Glidden and OSU's then president got together and agreed on a settlement - which was virtually identical to what was covered in Ohio's registration.

To the best of my recollection - which certainly can be flawed - no formal suit was filed.

I too have had trouble convincing some people I know as well as my family that this has happened.  The main thing they keep saying is "well if it happened, it would have been all over the news."  A bit irritating as my whole family is very pro-OSU.

Mike is essentially correct; however, the lawsuit, which I'm almost sure was actually filed, was specifically over the AttackCat logo and the use of the word "OHIO" on it.  At least that's how it started.  At the start Geiger, the AD at A&M, was quoted in the papers when the suit was filed that we could trademark "OHIO" in green but they wanted the right to trademark it in scarlet.  This is a paraphrase but it's pretty darn close to what he actually said.  It was right up there with "We are the poster child for compliance" and "I hope he [the football coach] doesn't fire me."  Yes, the more I think about the more certain I am that it was actually filed, because I recall some pre-trial stuff going on among the attorneys and the court.

I don't understand the attraction for OSU. Columbus is not a sweet college town. The Buckeyes do not put up 70 points offensively. They just aren't exciting. Their colors are ugly. They rarely win against top flight competition. Who in their right mind thinks they have a sweet team? If I had to pick an OSU to be a fan of I'd pick Oklahoma State. They play exciting teams like Oklahoma and Texas that realistically contend for National Championships. Nobody in the Big Ten could finish in the upper half of the Big XII this season.

There was a video floating around on the internet, all be it a bad quality, that was from the TODAY show which dealt with the case. It was a pretty good piece and at the end had Matt Lauer grin and hold up an OHIO mug and take a sip out of it.

If I find the link I will post it. However, as I said before, the video quality is pretty poor.

Not sure where you grew up, but in central Ohio tOSU is jammed down your throat everywhere you go. There are Buckeye displays in EVERY store you go in, a bunch of places that only sell bucknut crap, and the only sport the local news covers in the Bucks, and it's not just on sat, it is everyday.   People live for buckeye football, and if you don't you are looked at as a freak. All this buckeye overload, is the reason I let my "freak" out and have Attack cats all over my truck, fly my cat flag out front and proudly blast the 110 as drive around town.

Good for you, catfan70, good for you! 

You are a man after my own heart.  When I was a graduate student at O$U I wore my OHIO jacket around campus all the time and to many of the football games.  This was a type of jacket that was popular at the time that was green with white sleeves and trim with a big OHIO on the back in white against green.  The letters were sown on, not printed or stamped on. It was very high quality and was fairly expensive when I bought it.   I'd still be wearing this jacket, except it was burned up in a fire we had on the back porch of a house we were renting in Murray, Kentucky, in the mid-70s.

I'm with you CatFan70 from my OU license plates, to the flag and to the Attack Cat logo on my clothes.  Around her, you can tell how the Buckeyes are doing simply by taking note of how many of those car window flags you see from week to week.  It's pretty hilarious how those things come and go in a New York minute (or a Michigan State minute).

Just another example of your biased ignorance.  If you're going to make a statement like this, please try to have some basis rooted in fact.

If you choose to hate on OSU, go for it.  I won't stop you.  It's pretty hard to argue their history and results, however.  They've been to more BCS games and won more BCS games than any other program, and last year's win in the Sugar Bowl doesn't even count.  Continue to hate, but know EXACTLY what you're hating.

I'm with you catfan70.  Every time I go to Columbus, I wear my GREEN AND WHITE with BOBCAT logos.
I proudly have my OHIO BOBCAT license plates on two of my vehicles for all to see.  I have written the Dispatch, WTVN, and FoxsportsOhio letting them know that there are BOBCAT fans out here and that the MAC has 6 OHIO universities with athletes from all over Ohio that should get coverage and there are a lot of us who don't give a ****  for the team on the olentangy.  Another thing - I don't like the michigan coach calling that team in columbus OHIO - he needs to find another name for them.  To call them OHIO is disrespectful to the BOBCAT NATION.  GO CATS!!!

I agree.  I think all of us individually should write a letter to Coach HokemPokum, with a copy to the ADs of Michigan, Ohio State and Ohio, saying that we are offended by this incorrect reference and mentioning that it violates the out-of-court settlement between Ohio and Ohio State about a decade ago.  I'm sure if they get a few of these letters that Coach HokemPokum will be put in his place by his AD and told to cease and desist.  How many are willing to write such letters?  I'll compose one this weekend.  If anyone has the addresses for these three, please post as it will make it easier on on all.  OK, who's on board for this letter writing campaign?

As much as it upsets us, Brady Hoke is in no way bound by an out of court settlement between OHIO and Ohio A&M. He's not trying to sell anything with OHIO on it, so I don't see a trademark infringement here. As was brought up on another thread recently, a PR guy can ask/demand that his client be called "X", but that doesn't mean anyone has to listen.

It may not be a "legal thing" since Michigan isn't bound by the settlement with A&M.  However, I feel fairly confident that a few letters of this nature would convince the AD at OSU to call the AD at Michigan and mention that they'd appreciate HokemPokum calling them Ohio State.  When the coach speaks he is speaking not as an individual but as an employee of Michigan and  Michigan likes to stay cool with the NCAA football fraternity. 

As a legal matter, I know that we would squawk if anyone put "OHIO" in the end zone of a bowl game ever again when OSU was playing.  President Glidden personally told me of the letter he sent to the Rose Bowl to protest this one year;  they amended their ways the next time OSU was in that game by correctly placing "OHIO STATE" in the end zone.  Now, this is more a legal issue than is the case with HokemPokum, but I think a little moral suasion will go a long way to change his rhetoric.

Agree!.. I've been waiting to write a letter to coach hokempokem and the dispatch when they get ready to go against each other because ole coach hokempokem will no doubt refer to them as "OHIO" in the press before their game.  Post any ideas on where to send.  GO BOBCATS!!!

When the matter of the legal wrangling was brought up a year or so ago, there was a link to an archived story in which a high official at Ohio State commented that he didn't understand all the fuss, that they'd never put "OHIO" in green.

I just do not believe there is another school in America with the blind arrogance of OSU.

My thoughts on the matter are these:
  • The horseshoe ought to be named Ohio Stateium (or Stateum)
  • The honored role in the marching band ought to be crossing the "t" (or t's)

That was Andy Geiger, then OSU AD, when we first objected to their objection to our new AttackCat logo with the arched "Ohio" and our trademark of "Ohio" for athletic purposes.  It was shortly after that that the legal stuff started that ended up in the out-of-court settlement.

Start off a letter by saying you are "offended" by this, and you're just asking for it.

However, a polite request that the head coach of such an esteemed educational institution call a university, no matter how great they desire to beat them, by their proper full name (ohio state univ.) or short name (ohio state or osu) is not unwarranted, since he's incorrectly referring to a team and University not on his schedule when he says Ohio.

The other option is to use humor when making your point in differentiating the two institutions.

- You can't beat Ohio since you weren't playing them. OHIO was busy beating Miami for the sixth straight time on its way to another MAC East title this week, and therefore was unable to provide an opponent to your Wolverines this weekend. You should at least have some awareness of the school since you used to coach in the same conference and your memory can't be that short.

In general, I think our current administration from the Pres, to the AD is getting very lax with keeping up any momentum we gained in the late 90's or early 2000's. We don't have to be a football power to respect ourselves enough to protect our name.
