Sorry to dig up an old thread, but I'm way behind (obviously).  I think OCF once posted email addresses for the folks in Legal Affairs.  Of course I wasn't smart enough to save them.  OCF, would you mind posting again?  I really want to start reporting some of these shirts, etc.

Click here and you will find a Legal Affairs staff list with telephone numbers.  Click on the names in the list and you will see email addresses.

WSYX-Columbus has relapsed into calling us "Ohio U".  Is that something that can be addressed by legal?

Odd, ABC on Dish Network still refers to us as OHIO.

I don't think so. As I understand it, OU "requested" that the media refer to them in sports venues as Ohio. It's a request not a requirement.

Seems most are abiding by that request with the exception of OSU. They use "Ohio" continuously and within virtually every chant/cheer/song they do. I fear we were about 40 years too late with our legal pressure.

I believe that ticker is not produced by the local station, but rather at a production level higher up.

FYI...This past week I had a long chat with Ohio's legals affairs chief John Biancamano.  BTW, he was at OSU during the trademark dispute.  But John has no inherent allegiance to OSU as his bachelor's is from Yale and J.D. from Notre Dame.  (I asked him where he earned his degrees.)

While we were chatting he accessed BobcatAttack and copied, pasted and printed the threads on OSU deviating from the settlement.  He seemed serious about looking into the matter.

He also explained that both OU and OSU report to the state attorney general on legal matters and are not permitted to file suit against each other.  So, John says that all such settlements now must be "political."

Good work, Mike!

Since the out-of-court settlement to the original suit is a contract, I would assume that the AG's office would enforce it when violations were presented by either side. This would be violations by one the the universities involved (usually O$U).  The merchandise issue is something else all together.  I assume here the university would take individual action against the perps.

I would suggest having the AG sit out on this one, as he is a miami alum, and would have every intent of shafting us.

While he is a Miami grad -- and I chided him about that the last time he was in Athens -- he is very pro MAC.  So, I think he'd be fair about it.  By the way, he took the kidding very well.  He was even given a polite "boo" when he was introduced at the Athens County GOP meeting he was attending and his alma mater was mentioned.

Can we also sue Oklahoma somehow?  I mean, this is so confusing, it keeps me up nights, and really bothers me to a cellular level:

Thank you for this information. Very informative.

This certainly limits the University's channels to fix this problem. It seems to me that drawing the media's attention to the issue via legal action would need to be done by a 3rd party. A group of people who have an interest in protecting Ohio's name. Like, say, Ohio alumni.

Actually, the agreement does cover that t-shirt; however, only if it was licensed by OSU. The agreement and what's trademarked are two separate but related issues. I will say that in all their officially licensed gear that I've seen they have stuck to the agreement very well.  I guess an exception must have been made for those funky little caps that the band sometimes wears that say just "Ohio" inside some kind of a diamond.  If not, that is a violation and should cease.

No, but Oklahoma could sue us if we licensed a similar hat in green!

Penn State can afford the S-T-A-T-E flags and so can A&M.  I hope John Burns follows through and let's Ohio State know that this issue still matters.  When Tom Boeh was AD he was obsessed with this issue and adamant that Ohio University defend its trademark.

The Diamond Band Logo has been used by OSU since the 1930's and is in the agreement of acceptable usages of the word OHIO. Even though we try and claim the advent of this in the 1960's

John Burns has been retired for several years.

John Burns has been retired for several years. 


My bad.  Well I hope his replacement knows how important this issue is and looks into it.

Exactly.  If anyone sent that link to the University of Oklahoma's dyslexic legal affairs department there would be a letter sent to Ohio's legal affairs office asking them to stop using that design.  I earlier posted their trademark info and you can see that this clearly violates it.
