right now I would agree with you but once the game actually gets here and we have suffered through a year of listening to the scarlet and grey crap all year long, I have a feeling I would root for UM. I do hope the Michigan continues to get its butt kick by Michigan (green and white). I always root for the Michigan Spartans over Michigan Wolverines.

Well if you look at my profile it clearly states I live in the state of OHIO which is right under my username! I am a Michigan fan.

2 thoughts about our legal options (and I will be the first to admit that I know very little about intellectual property law):

(1) Is the State University of Michigan selling any licensed apparel referring to a university as "Ohio" without our permission? Because if so, they may owe us royalties.

(2) Does allowing an institution such as the State University of Michigan to refer to osu as "Ohio" weaken our legal argument that we are the only university that may refer to itself as "Ohio"? It seems to me it would. If osu were to become commonly known as "Ohio" through common use that they did not encourage in an unpermissible way, I would think they would then have an argument that we are not entitled to the exclusive rights to "Ohio." And if that is the case, ATTENTION BRADY HOKE AND ALL MICHIGAN FANS--YOU ARE ACTUALLY HELPING OSU BY CALLING THEM "OHIO," AND YOU ARE CAUSING OHIO DAMAGE, SO TAKE YOUR COMMENTS ABOUT THERE BEING NO DISRESPECT AND SHOVE THEM UP YOUR COLON BECAUSE YOU ARE IGNORANT, IGNORANT FOOLS!!!!!!!!!!!

It irritates the hell out of me that Hoke calls Ohio State University - "Ohio" and I am a huge Hoke fan.  I think he's a great person, and a great coach.  A lot of the guys here at work know him from football clinics and whatnot.  Either way, it bugs the bejesus out of me.

How would htis situation be different in another state.

Penn State refferred to as Penn

In any event, I agree that it is disrespectful, and it would be intereesting if anything ever went to court or anything other than the court of public opinion.  However, most people outside of Ohio (the state) probably don't care. Hopefully, Ohio (University, the Bobcats, OU) will beat Michigan, and then people can say that Michigan lost to two "Ohio's" in the same week.....

I have to say....who cares. I'm sorry. You think these weak 10+2 yahoos know there are other teams in the US? If they are anything like UK or OSucks Fans, the answer is no. We know we are OHIO. Good enough for me.

And then you have all the grey hairs on ESPN....we did not even register as a bubble team and now a few love our chances to beat Michigan? Give me a break with these clowns.

ESPN should flush all these has beens and start with some people that actually know what is going on in college basketball after the 80's.

To me, it mostly just makes the person using the term "Ohio" to refer to Ohio State look dumb, as if they don't know the difference. When I talk to people like my sister or her husband, who know nothing about sports, they are the kind of people who get names of schools wrong by excluding the word "State."

Here's the deal. It doesn't matter what you think. It doesn't matter what I think. Trademark law exists to ensure fair competition and eliminate confusion. If you do not protect your trademark in instances of confusion like this, it becomes possible that you will be unable to defend your brand in the future, viewing your knowing inaction as something of consent, setting a precedent. Regardless of our opinions, it is something legal should be following closely, especially if any type of merchandise is made.

Uhhhh, the Wolverines ARE referred to as U of M. Venture north of the state line and you'll find that out.

I would like to know if Hoke were caught using a derogatory term to refer to a particular minority group  and the press called him out on it, would his justification be "It's ok because I've been calling them that since I was 10 years old"?

Eroc, here is what you don't seem to grasp. Hoke, at age 10 was trying to offend Ohio State fans by referring to them as "Ohio", and he is still doing it. Obviously he considers mistaking them for "Ohio" to be an insult. Note that if he had a high opinion of Ohio University, he would not have chosen to do this, because calling Ohio State "Ohio" would have been a compliment.

From his own words, he knows the difference. Despite knowing better, he continues to use it because he knows it offends Ohio State fans. Therefore it is clear that, since he continues to use "Ohio" as an insult, he continues to have a low opinion of Ohio University. It is entirely reasonable therefore, for Ohio fans to be highly offended, and to find Hoke highly offensive, and also to find highly offensive any Michigan fans that follow his lead.

To put it in perspective, suppose I started insulting Michigan fans by saying "you're just an Eroc". Would you consider that a compliment? Now, you have no legal trademark on Eroc, I suspect, so the offense you could take would be considerably lower that the offense that would be appropriately taken by someplace that actually had a legal trademark on their name, say, Ohio University, when their name was being used as an insult.

This man, he gets it. This is the issue. We own the name "Ohio." If we allow "Ohio" to be used as a name for other universities, we no longer own it. What you call us is not what we're upset about.

You are correct.  In particular your closing clause is on point.  Reason: the trademark does not apply broadly but instead to licensed athletically related apparel and merchandise.

If Brady Hoke has been saying it since he was 10 years old and Beilein and other Wolverines are following ...then Ron White applies "you can't fix stupid".

Calling that school in Columbus, "Ohio" is giving them much too much undeserved credit.

Here's a good luck message I received from a buddy of mine who lives here in Columbus. He is a Detroit native and holds two degrees from the University of Michigan. He is a successful community leader and his strong education has helped him succeed professionally. Here is his message verbatim:

" I am rooting for Ohio. I am disgusted with Michigan's childish word games! Go Bobcats!

i couldn't care less, but his explanation and rationalization is what bothers me... if someone tells you its offensive or bothers them - then its something to consider - just because you say it isn't offensive doesn't make it right. Men use the word b*tch and ho's and women say its offensive, but if some says no it's not, does it make it alright?

I wonder did Brady Hoke

BREAKING NEWS: I have decided that referring to Brady Hoke as "Boorish, Childish, Naive, Insensitive, Imbicilic Fat F*ck" is not being derrogatory to Brady Hoke, and therefore I will only refer to him as that from this point forward.

I just hope that someone hasn't trademarked the rights for use of that term to sell athletic merchandise.

And for the record, I am with DFC, having grown up in Lancaster and always having pulled for a Michigan state university in Ann Arbor to beat tOSUcks.  I've also always held a Michigan state university in Ann Arbor in fairly high academic regard, and lived near Ann Arbor for a year and found it rather pleasant.

But I'm rethinking my position.

Also I am willing to beat that Coach Hoke didn't even know "Ohio University" existed when he was 10 years old by the way along with a lot of other people. No offense.

Since "Ohio University" seems to own the word "Ohio" as you guys are saying why not sell the state, sell the river, sell the street, sell the property in the state of Ohio, and sell the university? 

Hell why not actually call your school "Ohio" instead of "Ohio University"? That might actually help people out so they don't call them Bobcats or Ohio University or OU, or Ohio U.
