“Getting dollars to athletes for the real work that they do is important,” Hackney said. “But once you’re starting to pay them, you’re no longer operating a charity where you’re honestly there to educate these athletes. You’re there to pay them for a transactional business that’s not charitable anymore.”

Universities have employees. A lot of them. How does the fact that a subset of students also get paid fundamentally change the mission of a university?
Well, this law professor at Pitt thinks it's a potential problem to have a non-profit educational institution running a pro-athletic program. I've been wondering about this myself for quite awhile. Will have to see what type of rulings come down from the IRS and then, if that happens, what the courts have to say about it.

All the other employees of a university have some function that is directly or indirectly related to the university's educational mission. Even the groundskeeper and dormitory cook have that kind of nexus with education. With a football or basketball player the nexus is a little more tenuous.
IRS is getting their share. More an issue of the NLRB, their interpretation and the courts.

BLSS: Coaches are teachers and teaching PE has been around for a long time. But, I could see the exorbitant salaries being challenged if legal challenges as envisioned by the Pitt lawyer professor and others take place. You have your opinion. I have mine. We will see what happens going forward.

BTC: You may be right about where the challenges are likely to come from. Bottom line we are in unchartered waters.

Do you have an opinion? It doesn't seem like it. It seems like you're just deferring to what a guy quoted in an AP article said.

Your opinion here would mean that the Presidents of basically every major public university just set off a sequence of events that will result in universities losing their tax exempt status. And that with all of their very expensive, white shoe lawyers, lobbyists, and connections into state houses and congress, nobody thought about this but a professor at the 91st ranked law-school in the country.

From which my bother-in-law, who has successfully argued cases in front the U.S. Supreme Court on behalf of the Ohio AG's office, graduated. I don't think the justices thought his arguments any less valid because of the school he graduated from. Not saying this law professor at Pitt is correct, but just saying that sometimes minority opinions in law turn out in the end to be the majority opinions. This whole NIL Era is in its infancy, and there is still plenty of time for many twists and turns and reversals in the years ahead.

I guess you can't help yourself, but no it's not the current SCOTUS. He retired several years ago, though he still has an active law license and does some work for the current AG on a contract basis. The most notable case he won in front of SCOTUS was in the last century and involved Ohio tax law and an attempt by the auto industry to exempt themselves from a particular tax. They lost, and SCOTUS ruled that the tax applied to them. It was a highly technical case, and I don't remember any of the details. I have a reprint of that case somewhere. He was kind of proud of it, and distributed copies to family members. As I recall, it was a 9-0 decision.

He also has done some pro bono work for family members, including recently getting UPS to pay an insurance claim I had against them for a package stolen off the recipients porch that required a signature, which wasn't obtained. UPS was trying its best not to pay, until they received a letter from my brother-in-law with all kinds of slick legal wording, and saying I had retained him to file a law suit on my behalf. I then got the insurance check within 78 hours of UPS receiving that letter.

I had run-ins long ago with UPS/FedEx leaving packages that were signature required. If the package was sig required, they had no grounds to fight it.

May be open and shut legally, but I kind of doubt I would have gotten paid without my brother-in-law's intervention. They were putting up every roadblock you could imagine. I think they were hoping that I would just give up frustrated that I couldn't navigate their bureaucracy. I kept getting bounced from one department to another all asking for the same documentation all over again and claiming that they had no record of what the previous department had received. This had been going on for about a month. It was a complete nightmare. One letter from my high-powered lawyer ended it all!

Guess this was expected with all the talk about visa issues. My question is does anyone know if this guy is actually on campus now? If not, when will he be on campus? The redshirt situation is not the end of the world, but we have to get him on campus and enrolled.

I thought I saw him in practice videos with the team. Maybe I didn't. He's got a sim hair cut to AJB.

I'm fearful of any redshirt these days, but his tape looks so good I agree if we don't get him here and settled he might bounce before we ever see him on the floor.

Yeah, in light of whats going on I think we're seeing why the offers were so light. There must've been something out there known about this issue. And we have some depth to not worry right away. Fingers crossed. He runs the floor like Ndour.

I think we're in a good position program-wise to retain our top players. BVP and Sears seem like outliers at this point. We had no NIL collective and they were premium/established talents.

There was probably no keeping Sears regardless from going back home. BVP gave us 4 years.

We kept AJC and Shareef, who were likely the biggest threats to jump. The best case for Kuany after a redshirt would be a lateral move. I seriously doubt that happens since his visa would be an issue if he ended up elsewhere.

Provided that he does get here and eventually enrolls this school year, I don't see him leaving unless he absolutely hates being on this team or hates being in Athens. Firstly, where would he go? He's not going to have any film, so no one's going to know what they're getting into. Secondly, the minutes look like they'll be available next year with two rotation bigs exhausting eligibility.

Redshirting when he hasn't been around for summer workouts and other team activities is the right call. Even in this era of easy player movement, you still need to do right for the kid.
