One simple issue that is overlooked in this entire issue was the fact that there was no real animosity between the two schools until Tom Boeh moved to Trademark the word OHIO (when we rolled out the new Attack Cat Logo and it's sister arch OHIO logo), and that is what triggered the law suit.  On the side note, we ripped off the Oklahoma OU for baseball hats and wore that illegally for years.

  Hmm . . . that's an interesting piece of revistionist history.  It may have been beneath the surface a little and the lawsuit brought it out in the open, but to say that it didn't exist is not exactly accurate.  Ask Vern Alden about that one.

Shut up.  SeriOUsly.  I'm in OHIO and in yOUr face.  The University of Oklahoma is entitled to all the UO they want.

They are not OU.

OCF:  Check the dates, it is a simple documented time line, I will let facts stand on their own merit.  I will also mention that Vern Alden, as great a man as he is, was 18 years removed from this issue, I never said there was NO issues, I said real issues, at least none serious enough to bring out court action.  Ohio University filed a trademark patent on the term OHIO in the Arch form, and this triggered the lawsuit.  For years the two sides co-existed with some minor flare ups, but this was seen by both sides as a move on the others turf, and a childhood spat convened.

Monroe, you can babble all you want, once again check some facts, Oklahoma has a trademark on the interlocking OU, and has for years, many years.

oklahoma's ou logo is a slanted interlocking OU, we've never used anything like that. the logo on our baseball caps was always upright.

Better think again, the Oklahoma logo was trademarked in several different ways, one being the straight up and down (as evidenced by Oklahoma Football helmets), and one being the slanted interlocking OU's



Here is documentation that the OU upright logo has been in use since 1966 on helmets, this logo has been the primary mark since 1996, and was trademarked many years prior.

Better think again, the Oklahoma logo was trademarked in several different ways, one being the straight up and down (as evidenced by Oklahoma Football helmets), and one being the slanted interlocking OU's

Pretty sure you are incorrect here. Don't have time to look it up but I remember seeing the document once and thought it said "the establishment of a university at Athens, to be known as The Ohio University."

any reference to the Ohio University,"the" is in lower case, meaning the is not part of the title.  If "the" was a proper name the "The" would be capitalized and all reference in the charter documents would read The Ohio University.  Since the charter documents read the Ohio University, "Ohio University" is referred to as the proper name.

Geesh guys as poor as I am in the English language, I even learned that in school. 


The last line from the 1st paragraph from link above on the establishment of Ohio University:  "This clause in the Ordinance of 1787 was actually the beginning of Ohio University."

I have no answer for that, however the diploma is the only place The is ever referenced regarding Ohio University as a proper name.  None of the history or literature, nor other legal documents use The Ohio University.

This discussion got me wondering if the state legislature officially refers to osu as "The Ohio State University." Sure enough, there it is:

Ohio Revised Code Sec. 3335.01. The educational institution originally designated as the Ohio agricultural and mechanical college shall be known as “The Ohio State University.” The leading object shall be, without excluding other scientific and classical studies, and including military tactics, to teach such branches of learning as are related to agricultural and mechanical arts. [SIDE NOTE: HA! They really are cow college].

That got me thinking what they call us. It looks like it's "The Ohio University" officially:

Ohio Revised Code Sec. 3337.01(A). The body politic and corporate by the name and style of “The President and Trustees of the Ohio University” now in the university instituted and established in Athens by the name and style of “The Ohio University” shall consist of a board of trustees composed of eleven members, who shall be appointed by the governor, with the advice and consent of the senate.

Interestingly, in the rest of the Code chapter, "the" and "university" are not capitalized. I thought that might mean something, but then I noticed it does the same thing for osu. Miami never gets their "university" capitalized, though, because Miami sucks.

Well that makes things even more interesting and at best inconsistent.  I guess I would go with what each school calls itself, OSU wants that three letter word out in front and uses said word.  Ohio University does not use the in either its logo marks, or media tip sheets for how to refer to Ohio University.  As for an official answer....Who knows :)

The Ohio Revised Code and Ohio Administrative Code are riddled with typographical errors. Miami university should be proud.

JCW, this is not correct.  I have seen, in the past, either the original or an exact copy of the original 1804 charter.  It clearly says "The Ohio University."  It's full of eloquent 19th century prose and says something like "Hereby established an university 'in the name and style of The Ohio University.'"  That is why all diplomas issued by our fair college have always said "The Ohio University" on the top line. 

Edit for Shawn:  The part of the revised code that you cite for the "The" in OSU's name was passed by the General Assembly in 1914.   Adding the "The" was a compromise.  OSU officials had originally asked for the school's name to be changed to the University of Ohio, because they wanted a prestigious name like the University of Michigan.  The legislature balked, for obvious reasons, that go over the head of most current OSU football fans.

Well you must be older than we all thought if you have seen the original   I have looked at no less than four different sources on line of copies of the document and they all read the same way, as well as wording and references on the official webpage about the history of Ohio University, and even referenced my hardback copy of the History of Ohio University which has a photo of the charter, and they all have the in lower case.  Not saying you are wrong, stating that I have yet to find any refuting fact besides the very confusing Ohio General Assembly read above.

interesting that osu continues to brag about their traditions even though they have stole many from other schools or organizations. (script ohio, band uniforms just too name two.) I was at a osu hockey game last year when the p.a was giving instructions on how to do cheers that were stolen from michigan. Yes osu should be proud of everything they have accomplished.
