According to the link below, former player Lorenzo Fisher agreed to a plea deal in exchange for testifying against his former teammate, Omar Leftwich.

Here was the original thread about this drug ring, and the original story. Following the story, both Windham and Fisher were dismissed from the team immediately. In later news, Windham pled guilty to a 4th degree felony, which was being held in abeyance provided he successfully completes a year in the diversion program. They agreed to this because he apparently was just running an errand for Fisher, only did it one time, and really wasn't the dealer.

At this point, with his legal affairs now cleared up (so long as he remains in good standing in the diversion program), Windham appears to be back on the team, but Fisher is gone, as he should be.

LC, did we all miss something or is the inclusion of Lefttwhich new to this case?  Do not remember ever seeing his name in the original news stories.  And this news story only says this guy testified against Leftwhich, but not in regards to charges.

This is the first time I recall seeing Leftwich mentioned with regards to this case, but the way the story presents it makes it sound like it isn't a recent development, so I'd say it's probably been news, and we missed it. It is very interesting the way the story presents it, though. Fisher testified against Leftwich, but it doesn't say Leftwich was involved with the drug ring, so it leaves it entirely open what exactly Leftwich was charged with.

My concern here, for all involved and the University, is since this one was just arrested on a sealed Grand Jury indictment, could there be more info to come on others.  The inclusion of leftwicth in the manner he's included is really odd to me.  I hope not, we do not need any of this!

Doing a name search in the Athens Municipal Court Records online reveals little. It shows Thomas O. Leftwich being evicted for non-payment of rent in mid-2012, pleading guilty to an open container violation from 8/12/12, and pleading to a reduced charge on a charge of persistent disorderly conduct from 1/13/2013. There are also serious charges from 11/5/2012, a drug possession charge (felony 4) and an aggravated possession charge (felony 3), but they show that they were dismissed. These would have been long before the Fisher/Windham case broke in August 2013.

Edit - NVM - also searched for Windham and Fisher. Windham shows a clean record except a speeding ticket, and Fisher shows an assault (M1) from 5/17/2013 guilty, disorderly conduct from 12/28/2013 not resolved yet. The drug charges don't show for either of them. Obviously any drug dealing charges that were filed weren't filed in Municipal court, but were filed elsewhere, perhaps Federal court?

That is why I brought up the Grand Jury Indictments, those will not show up on that docket.  Many cases that begin in that court are dismissed when it gets kicked up to the Grand Jury.  Maybe some lawyer types can explain this to us lay people.

Ok, here is the link to search the Court of Common Pleas. Leftwich's case has been going since January 2013, and doesn't seem to be resolved yet.  It apparently predates the incident with Windham and Fisher.

Yeah, there's not a lot making sense in this. Leftwich is charged with 3rd degree felony possession, and hasn't been up for trial yet (it looks like the court is currently considering some expert qualification issues, which was the Daubert hearing on Feb. 21). Fisher has pled guilty to four counts of 4th degree trafficking (plus a separate trespassing charge), which is what he was originally charged with, so it's not like he pled guilty to reduced charges in exchange for testimony.

Leftwich is charged with the more serious offense, but I would think that the fact that there were 4 separate counts against Fisher would militate against that. Maybe both turned on this club baseball player?

On a related note, I see a search warrant was issued against Leftwich on 11/8/2012. Wasn't he mysteriously absent at the end of that season? I was thinking I attributed it to injury, since half the team was out with injury in November 2012, but maybe this was the actual story.

He did not play at all in 2012. He left the team and the University prior to spring practice in April 2102, supposedly related to academic reasons, as per bobcatattack.com. That was long before the search warrant.

(When you are looking for an old thread, a working search function would be handy. I just happened to start at page 100, and was going to come forward, but accidentally went backwards and found it on page 101. I'd rather be lucky than good, I guess).

Yes, Octavious was still on the team in 2012, and I seem to recall that he played sparingly. I don't know if he had injuries that affected him, or it was just a matter of others playing better.

So what is the acceptable number of times you can run drugs?

I would say that's a question for the legal authorities, not something we can answer here. In the case of Windham, the authorities reached the conclusion that the diversion program was a suitable punishment for him. Since if he completes the diversion program, the incident will be removed from his record, it seems logical that Windham will then be eligible to play again. By contrast, Fisher apparently will have a felony 4 on his record, so it seems logical that he would not be be eligible.
