Man, this whole thing is giving me flashbacks to my 1L torts class. This absolutely will make it onto some law professor's final exam as an essay question.
While I'm not a lawyer, I did once play one in the classroom. ;-) In a time long ago in a galaxy far away I taught journalism law.

Were you drinking at the Holiday Inn Express? That would make you a drunken expert with a sarcastic lip. ;-)

For the record, Todd is a personal friend, though I've lost contact with him over the years. We used to play sandlot football together on the top of the Highland Avenue reservoir.

I haven't kept up on this aspect of the law much, but as I recall she could be considered a limited purpose public figure, but a lot depends on the circumstances -- whether she became part of a controversy by her own actions or was dragged into it by the guys making the statements. I think that's where courts have been pulling back. She could have a good case if they presented their statements as "fact" rather than "opinion," although "opinion" doesn't make it go completely away.

And only two people have threatened to sue me in the history of BobcatAttack.
I like to think that we don't have any salacious rumor mongering posters around here, but you guys also do a great job of maintaining and enforcing standards with respect to all kinds of rumors.
