. . . With Loser Pays, a completely ridiculous case like Ohio State suing Ohio for using the name Ohio would never have come to fruition. That is reason alone to support it.
Well, it might be, but I doubt it. The arrogant folks at O$U actually thought they had a good case when they sued us. It wasn't until their lawyers discovered what our lawyers had as evidence that it finally dawned on them that they were going to lose in court. Sports reference to Ohio University as "Ohio" in the 1890s. They had no idea. Loser pays might stop many frivolous law suits, but it wouldn't stop the ones based on pure arrogance laced with stupidity.
